Abstract |
This article is devoted to a joint-stock agreement, which is characterized as a legal mechanism for managing a legal entity (joint-stock company) along with the law and the constituent document (charter) and as one of the ways to effectively exercise the right of participants to manage a joint-stock company. Within its framework, an analysis of the concept of this civil structure was carried out. In addition, the work considers various approaches to determining the legal nature of a joint-stock agreement. The considered type of corporate contract has already managed to prove its necessity and practical significance both in international and in domestic corporate legal relations. In this regard, the analysis of the legal design of the joint-stock agreement is relevant both from the point of view of the theory of civil law and from the point of view of law enforcement practice. |
